What is mediation?

Mediation is a voluntary, confidential process in which a neutral third party — the mediator — helps disputing parties communicate and negotiate toward a mutually acceptable resolution. Unlike litigation, mediation is flexible, private, and typically faster and less costly.

What types of employment disputes can be mediated?

Gail mediates a wide range of employment disputes, including wrongful termination, discrimination, harassment, retaliation, individual and class action wage and hour, California Private Attorneys General Act ("PAGA"), breach of employment contract, and general workplace conflicts.

How long does a mediation session take?

The length of a mediation session varies depending on the complexity of the dispute. Employment law mediations typically require full-day, eight hour sessions, though some matters may require multiple sessions to reach resolution.

Is mediation confidential?

Yes. Mediation is a confidential process. Statements made during mediation generally cannot be used as evidence in subsequent legal proceedings, which encourages open and honest communication between the parties. When the parties agree to use Gail as their mediator, they are also assenting to refrain from subpoenaing her or her records in any legal proceeding.

Do I need an attorney to participate in mediation with Gail?

Yes, Gail only works with parties represented by counsel, and she ensures that all voices are heard throughout the process.

How do I schedule a mediation with Gail?

You can schedule a mediation by visiting the Scheduling page on this website, by calling Case Manager Siena at 310.424.8688, or e-mailing Siena at [email protected]. Gail prefers to mediate cases remotely, via the Zoom platform.

What happens if we reach an agreement?

If the parties reach an agreement during mediation, their lawyers will memorialize the terms in a written settlement agreement. Gail encourages the parties to exchange a draft settlement agreement before the mediation session so that they can finalize the paperwork promptly in the event they reach agreement during the mediation session.
